The Merchant Shipping (Port State Control) Regulations 2026
The United Kingdom is a signatory to the Paris Memorandum of Understanding on Port State Control which provides an international regime for the enforcement of standards for ship safety, pollution prevention and shipboard living and working conditions.

Enabling power
The Secretary of State, with the consent of the Treasury, makes these Regulations in exercise of the powers conferred by— article 3 of the Merchant Shipping (Prevention of Oil Pollution) Order 1983; article 3 of the Merchant Shipping (Prevention and Control of Pollution) Order 1987; article 3 of the Merchant Shipping (Prevention and Control of Pollution) Order 1990; article 2 of the Merchant Shipping (Prevention of Pollution) (Law of the Sea Convention) Order 1996; article 2 of the Merchant Shipping (Control of Pollution) (SOLAS) Order 1998; articles 2 and 3 of the Merchant Shipping (Prevention of Air Pollution from Ships) Order 2006; articles 3 to 5 of the Merchant Shipping (Prevention of Pollution by Sewage and Garbage) Order 2006; articles 3 and 4 to the Merchant Shipping (Control and Management of Ships’ Ballast Water and Sediments) Order 2022; articles 3 and 4 to the Merchant Shipping (Control of Harmful Anti-Fouling Systems on Ships) Order 2022; the 1995 Act sections 85(1), (3), (6) and (7), 86(1)(a) to (d), 128(5) and (6), 302(1) and 306A of the Merchant Shipping Act 1995 (“”); the 2023 Act sections 14(2), (4)(b), (c) and (e) and 20(1)(a) and (b) of the Retained EU Law (Revocation and Reform) Act 2023 (“”). The Secretary of State is the relevant national authority for the purposes of section 14(2) of the 2023 Act. In accordance with paragraphs 2(1) to (3) and 5(1) of Schedule 5 to the 2023 Act, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament. In accordance with section 86(4) of the 1995 Act the Secretary of State has consulted the persons referred to in that section.
