the 2023 Act The Secretary of State, with the consent of the Treasury, makes these Regulations in exercise of the powers conferred by sections 85(1), (3)(a) and (f), and (5) and (7), 86(1)(a) to (d) and 302(1) of the Merchant Shipping Act 1995and sections 14(1) and 20(1)(b) of the Retained EU Law (Revocation and Reform) Act 2023(“”). The Secretary of State has consulted such persons in the United Kingdom as the Secretary of State considers will be affected by the exercise of powers in this instrument in accordance with section 86(4) of the Merchant Shipping Act 1995. The Secretary of State is a relevant national authority for the purposes of section 14(1) of the 2023 Act. The requirements of paragraph 6(2) of Schedule 5 to the 2023 Act (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.
