These Regulations revoke and replace the Merchant Shipping (Accident Reporting and Investigation) Regulations 2012 (S.I. 2012/1743) (“the 2012 Regulations”).

Enabling power
The Secretary of State makes these Regulations in exercise of the powers conferred by sections 267 and 306A of the Merchant Shipping Act 1995and by section 112(1)(a) and (c), (3) and (5) of the Railways and Transport Safety Act 2003. In accordance with section 112(7)(c) of the Railways and Transport Safety Act 2003, the Secretary of State has consulted such organisations in the United Kingdom as appear to the Secretary of State to be representative of persons who will be affected by the amendments made by these Regulations under that Act.
