The Department for Transport seeks views on proposals to transpose Directive 2012/34/EU. This would establish a single European railway area for the UK and the UK side of the Channel Tunnel and repeal and consolidate (‘recast’) previous EU legislation for ease of reference.

We are asking for specific feedback on proposed methods to implement the directive, keeping previously transposed optional derogations and the regulatory body’s powers to fine.

The draft Railways Infrastructure (Access and Management) and Railways (Licensing of Railway Undertakings) (Amendment) Regulations 2015 would implement this directive in the UK.

The draft regulations make amendments to existing policy which relate to the:

  • access and management of railway infrastructure, including services
  • licensing of railway undertakings
  • role of the Office of Rail Regulation
