Supplementary protection certificate waiver: no deal legislation
We’re seeking views on proposals to fix issues in supplementary protection certificate (SPC) law in the event of a ‘no deal’ EU exit.
Last fetched 03 May 2026 · gov.uk
Detail
The EU has recently made changes to legislation on supplementary protection certificates (SPCs), to introduce an “SPC manufacturing waiver”. The waiver allows third party manufacturers to make SPC-protected medicines in certain circumstances.
If the UK leaves the EU without a deal, these changes will automatically become UK law on exit day. Parts of the retained changes will need fixing so that they continue to work as UK law.
The government is seeking views on how we propose to make those fixes. The document explains what the fixes are, and what the proposed legislation looks like.
