The Counter-Terrorism and Security Act 2015 (Code of Practice for Officers exercising functions under Schedule 1) Regulations 2015

These Regulations bring into operation the code of practice (“the Code”) issued under paragraph 18(1) of Schedule 1 to the Counter-Terrorism and Security Act 2015 (“Schedule 1”). Schedule 1 provides police officers, immigration officers and customs officials with powers to both seize and retain travel documents of persons at ports. Paragraph 18(1) of Schedule 1 requires the Secretary of State to issue a Code of Practice with regard to the exercise of functions under Schedule 1 and in particular in relation to: the procedure for making designations in respect of officers; the training to be undertaken by officers; the exercise by officers of functions under Schedule 1; the information to be given to a person subject to the exercise of powers under Schedule 1 and the process for disclosure of that information; and reviews of the exercise of the power to retain documents. The Code, which these Regulations bring into operation, satisfies these requirements.
