The Supply of Machinery (Safety) (Amendment etc.) and the EU Machinery Regulation (Enforcement etc. in Northern Ireland) Regulations 2026
The Supply of Machinery (Safety) Regulations 2008 (S.I. 2008/1597) (“the 2008 Regulations”) implemented Directive 2006/42/EC of the European Parliament and of the Council on machinery (“the Directive”) in the United Kingdom when the United Kingdom was a member of the European Union. Arising out of the United Kingdom’s withdrawal from the European Union, the 2008 Regulations were amended to ensure that deficiencies were corrected in relation to Great Britain (England and Wales and Scotland). The 2008 Regulations were also amended to ensure that machinery products meeting specified requirements of the Directive were able to be placed on the market in Great Britain.

Enabling power
The Secretary of State makes these Regulations in exercise of the powers conferred by section 8C(1) of, and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018 and sections 1, 2 (except subsections (2)(e), (3)(e) and (3)(i)), 9(1) and 13(2) of the Product Regulation and Metrology Act 2025. In accordance with section 2(8) of the Product Regulation and Metrology Act 2025, the Secretary of State has had regard to the social, environmental and economic impact of making regulation 2(4) and (5) of these Regulations. In accordance with section 13(6) of that Act, the Secretary of State has consulted such persons as the Secretary of State considered appropriate. In accordance with paragraphs 8F and 38 of Schedule 7 to the European Union (Withdrawal) Act 2018, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.
