The Scotland Act 2012 (Commencement No. 5) Order 2015
Article 2 of this Order commences sections 1 and 3 of the Scotland Act 2012 (c.11) on 1st July 2015. Section 1 transfers certain of the executive functions in section 12 of the Scotland Act 1998 (c.46) relating to the conduct and administration of Scottish Parliament elections, which are currently exercisable by the Secretary of State, to the Scottish Ministers. It also introduces a new section 12A which sets out the powers to make provision about elections that continue to be exercisable by the Secretary of State. Section 3 makes supplementary and transitional provision in connection with the transfer of responsibility to the Scottish Ministers.
