The Representation of the People (Overseas Electors etc.) (Amendment) (Northern Ireland) Regulations 2024
The Elections Act 2022 (c. 37) amended the Representation of the People Act 1985 (“the 1985 Act”) (c. 50) to expand the franchise for parliamentary elections in respect of British citizens overseas, removing the 15 year limit on voting for British citizens overseas and allowing registration based on both previous registration and previous residence in the United Kingdom.

Enabling power
The Secretary of State makes these Regulations in exercise of the powers conferred by the provisions set out in the Schedule. The Secretary of State has consulted— the Electoral Commission, in accordance with section 53(5)(a) of the Representation of the People Act 1983and section 7(1) and (2)(e) and (h) of the Political Parties, Elections and Referendums Act 2000, and the Information Commissioner and such other persons as the Secretary of State considers appropriate in accordance with section 53(5)(b) and (c) of the Representation of the People Act 1983. A draft of these Regulations has been laid before, and approved by a resolution of, each House of Parliament in accordance with section 201(2) of the Representation of the People Act 1983, section 96(2)(b) of the Northern Ireland Act 1998, section 154(2)(b) of the Police Reform and Social Responsibility Act 2011and sections 18(8) and 21(6)(a) of the Recall of MPs Act 2015.
