These Regulations amend the Occupational Pension Schemes (Preservation of Benefit) Regulations 1991 (S.I. 1991/167) (“the Preservation Regulations”).

Enabling power
The Secretary of State makes these Regulations in exercise of the powers conferred by sections 73(4)(b) and 182(2) of the Pension Schemes Act 1993. In accordance with section 185(1) of that Act, the Secretary of State has consulted such persons as they consider appropriate.
