The Marine Recovery Funds Regulations 2025
These Regulations are made under section 292 of the Energy Act 2023 (c. 52) which enables the Secretary of State to make regulations providing for the establishment, operation and management of one or more marine recovery funds (“MRF”). An MRF is a fund into which payments may be made in respect of activities in connection with offshore wind electricity generation and out of which payments may be made towards expenditure on measures to compensate for adverse environmental effects of such activities (“measures”).

Enabling power
The Secretary of State makes these Regulations in exercise of the powers conferred by sections 292 and 331(2)(a) of the Energy Act 2023. Before making these Regulations, the Secretary of State has consulted the Scottish Ministers, the Welsh Ministers, the Department of Agriculture, Environment and Rural Affairs in Northern Ireland and such other persons as the Secretary of State considered appropriate, in accordance with section 292(12) of the Energy Act 2023.
