Accordingly, the Secretary of State makes the following Regulations, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972 and the following sections of the Energy Act 2011— section 2(9) and (10); section 3(1), (3) and (5) to (9); section 4(1), (4), (5), (8) and (9); section 5(1), (3) and (5); section 6(1), (2), (4) and (5); section 8(3) and (4); section 13(1) and (2); section 15(1) and (2); section 16(1) and (2); section 34(1) and (2); section 35(2) to (4); section 40(1).
