The Civil Legal Aid (Merits Criteria) (Amendment) (No. 3) Regulations 2013 (revoked)
Regulation (EU) No. 604/2013 of the European Parliament and of the Council of 26 June 2013 establishing the criteria and mechanisms for determining the Member State responsible for examining an application for international protection lodged in one of the Member States by a third-country national or a stateless person (“Dublin III”) makes provision for determining which Member State of the European Union is responsible for examining an asylum application made in one of the Member States by a third-county national or stateless person. Article 27 of Dublin III makes provision ensuring that legal aid is provided in relation to challenges to a transfer decision within the meaning of Dublin III, subject to a means and merits test.
