Implementation of the ILO Work in Fishing Convention 2007 (ILO 188) into UK Law

ILO 188 introduces international minimum standards of living and working conditions for all commercial fishermen.

ILO 188 entitles all fishermen to written terms and conditions of employment (a fisherman’s work agreement) decent accommodation and food, medical care, regulated working time, repatriation, social protection and health and safety on board. It also provides minimum standards relating to medical fitness.

ILO 188 standards will apply to all fishermen working on commercial fishing vessels of any size. They apply equally to employed fishermen and non-employed (share) fishermen.

The documents attached set out our proposal for legislation to implement ILO 188 into UK Law. We welcome comments on all aspects of the consultation package.

1.Explanatory Table

Draft Statutory instruments

Our package contains four proposed statutory instruments (SI) which contain legislative changes necessary to implement the ILO 188 Convention into UK Law. You may find it helpful to look at these in conjunction with the explanatory table.

6.The Merchant Shipping (Work in Fishing Convention) (Survey and Certification) Regulations 2017

7.a. Impact Assessment (IA)

This document is an analysis of the known costs and benefits of implementing ILO 188. We welcome your views on this and evidence for any differing or additional costs.

We have included questions in the IA about the particular areas where we would like to have more evidence. We have also provided a separate summary sheet (7.b.) of the questions.
